Terms and Conditions
1. General Provisions
These general conditions of sale (hereinafter the “General Conditions of Sale”) regulate the sale between Elleci di Cattani Linda (VAT number 02772630394), hereinafter the “Seller” and the customer, hereinafter the “Purchaser”, in relation to the goods and/or services (hereinafter jointly the “Goods”) marketed by the Seller through the e-commerce channel www.ellecipochette.com, hereinafter the “Site”.
These General Conditions of Sale apply to the sale of Goods carried out on the website www.ellecipochette.com in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by Elleci di Cattani Linda.
The Buyer is required, before accessing the goods supplied by the Site, to read these
General Conditions of Sale, in the terms in force, which are generally and unequivocally accepted at the time of purchase.
The Buyer is invited to download and print a copy of these General Conditions of Sale, the terms of which the Seller reserves the right to modify unilaterally and without notice.
By purchasing the Goods through the Platform, the Buyer declares to have read and
expressly approve these General Conditions of Sale.
2. Object
These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for the Seller's Goods and do not govern, however, the supply of services or the sale of products by parties other than the Seller who are present on the same Site via links, banners or other hypertext connections.
Before placing orders and purchasing products and services from different entities, we suggest checking their conditions of sale.
Elleci di Cattani Linda sells the products on the website www.ellecipochette.com to retail and end consumers.
3. Conclusion of the contract
By placing a purchase order on the Site, the Buyer guarantees that he or she is of legal age, has the necessary legal capacity and is legally authorised to enter into purchase contracts.
In completing the registration procedures, the Buyer undertakes to follow the instructions on the Site and to provide his/her personal data truthfully and correctly. The confirmation will in any case exonerate the Seller from any responsibility regarding the data provided by the Buyer who undertakes to promptly inform the Seller of any change in his/her data communicated at any time.
If the Buyer communicates inaccurate or incomplete data or, even in the event of a dispute by interested parties regarding the payments made, the Seller has the right not to activate or to suspend the order until the relevant deficiencies are rectified.
By sending the purchase order, the procedure of which is considered concluded when the Buyer clicks on the "Complete order" button, the Buyer acknowledges having read, understood and accepted all of these General Conditions of Sale.
The acceptance of the purchase order by the Seller will take place by sending an order confirmation to the email address that the Buyer must indicate during the purchase procedure on the Site, it being understood that the aforementioned means of communication is expressly accepted by the Buyer for the exchange of information relevant to the conclusion of the sales contract.
4.Products
The visual representation of the Products has an indicative value and is intended only to present them for sale, without any guarantee or commitment, by the Seller regarding the exact correspondence of the image visible on the site with the actual Product; in particular in relation to its actual dimensions and/or the colors of the Products and/or packaging. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.
5. Product Availability
The availability of the Goods refers to the actual availability at the time
the buyer places the order. This availability must however be considered
purely indicative because, due to the possible simultaneous presence of multiple Buyers on the Site, the Goods could be sold to other Buyers before the order is confirmed.
Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected by eliminating the unavailable product and the Buyer will be immediately informed by email.
The buyer will have the opportunity to request cancellation of the order before
shipment, terminating the contract. The Seller will refund the amount paid within 14 days from the moment in which he became aware of the Buyer's decision to terminate the contract.
6. Payment methods and prices
The prices of the Goods for sale on the Site do not include shipping costs. Shipping costs are explicitly highlighted at the time the order is placed.
Prices are subject to change at any time. Changes do not affect orders for which an order confirmation has already been sent.
In the event of an obvious error in the indication of prices on the Site, the Seller will notify the Buyer as soon as possible, allowing confirmation of the order for the correct price, or cancellation. In any case, the Seller will not be obliged to supply when sold at the lower price erroneously indicated.
Once you have selected the Goods, they will be added to your cart. Simply follow the instructions for purchasing, entering and verifying the information requested at each stage of the process. The order details can be modified before payment.
Payment can be made via Paypal, Bank Transfer or Satispay.
For orders with bank transfer, the goods will be shipped only once the bank transfer has been received for payment purposes. If, after 15 calendar days from the order, the bank transfer has not been received in the Company's current account indicated for payment purposes, the order will be automatically cancelled.
In any case, payment must be made in a single solution and in advance.
7. Billing
If the final consumer customer wishes to request an invoice, he/she must request it before placing the order by sending an email to ellecipochette @gmail.com
8. Delivery and transport
The Seller ships to the following geographical areas: Italy.
The delivery term is merely indicative and not essential. If no delivery date is indicated, the same will be carried out in
a reasonable period from the date of conclusion of the contract, except in cases of force majeure.

9. Receipt of the Goods and Transfer of Risk
Upon receipt of the Goods and before signing the document of the Courier who will deliver the goods, it is advisable for the Buyer to carefully check that the physical condition of the packages has not been altered, and that they bear the Seller's personalized logo.

10. Warranty and commercial compliance
The Seller is responsible for any defects in the products offered on the Site, including non-conformity of the items with the products ordered, in accordance with the provisions of Italian law.
If the Buyer has entered into the contract as a consumer, i.e. any natural person acting on the Site for purposes other than any business or professional activity, this guarantee is valid provided that the defect occurs within 24 months from the date of delivery of the Goods, and that the Buyer submits a formal complaint regarding the defect within 2 months from the day on which the defect was discovered.
If the Buyer encounters a problem with the product sold by
Elleci di Cattani Linda and wish to avail of the guarantee, must contact the Seller at the email address ellecipochette@gmail.com sending photos showing the defect. Once the Seller has ascertained the extent of the defect, he will repair the product, unless he deems it more convenient to replace it.
The warranty does not cover product defects caused by incorrect or lack of maintenance, by natural wear and tear of the product due to time (e.g. broken zip, label or fabric discolored by time) or by defects caused by improper use.
11. Seller's Responsibility
The Seller guarantees that the Goods comply with all the safety standards imposed
mandatory by Laws, Provisions and Regulations in force in Italy and in the European Union.
The Seller declines all responsibility for any damage to things and/or people
arising from the use of the Goods not in accordance with the instructions, as well as damage to things and/or people arising from the execution of the delivery service.
The Seller shall not be liable for any indirect damages caused by the Goods.
12. Right of withdrawal
For products delivered within the national territory (Italy), the Buyer, who is a consumer, may withdraw from the contract within the longer term of 14 days provided for by art. 57 of Legislative Decree no. 206 of 2005.
For products delivered outside the national territory, to Buyers who have the qualification of consumers, the return is guaranteed within the 14 days provided for by art. 57 of Legislative Decree no. 206 of 2005, starting from the date of receipt of the products.
The right of withdrawal may be exercised exclusively by Buyers who are consumers pursuant to the relevant legislation, i.e. natural persons who have purchased the products for their own use and for purposes not related to their professional or entrepreneurial activity.
The right of withdrawal is exercised by the Buyer by sending an email to ellecipochette@gmail.com
The consumer who has exercised the right of withdrawal must return the goods within and no later than 14 calendar days from the date on which he receives confirmation of withdrawal from the Seller and instructions on how to proceed.
The return costs will be borne by the Buyer.

The goods must be returned intact, in their original condition and packaging.
(including box, labels), in perfect clean condition,
complete with all their parts, any gifts and any attached tax documentation.
The products must not have been washed.
In the event that the returned products are found to be non-compliant with the above, the Seller reserves the right to refuse the return, returning the damaged or non-compliant goods to the Buyer. Once the conformity of the returned products has been verified, the Seller undertakes to refund, within 14 days of receiving the returned goods, the amount paid by the Buyer at the time of purchase.
The Seller will carry out the refund using, where possible, the same means of
payment chosen by the Buyer during the purchase phase. In any case, the refund may be made by bank transfer, therefore if the Buyer intends to exercise his right of withdrawal, he must also provide the bank details (IBAN and SWIFT).

14. Applicable law. Exclusive jurisdiction
These General Conditions of Sale are governed by Italian law.
The application of the laws of other countries and of the 1980 Vienna Convention on the International Sale of Goods is expressly excluded.
If the Buyer is a consumer or user pursuant to and for the purposes of art. 3, paragraph 1, letter a) of Legislative Decree no. 206 of 6 December 2015 and subsequent
modifications, for any dispute between the Buyer and the Seller, relating both to these General Conditions of Sale and to any contract concluded between them, the Court of residence or domicile of the Buyer will have jurisdiction.
If the Buyer does not qualify as a consumer or user pursuant to and for the purposes of art. 3 paragraph 1, letter a) of Legislative Decree 6 December 2015, no. 206 and subsequent amendments, the Court of Ravenna shall have jurisdiction over any dispute between the Buyer and the Seller, relating to both these General Conditions of Sale and any contract concluded between them. In any case, the Seller retains the right to take action against the Buyer before the courts of the latter's place of domicile.
15. Intellectual Property Rights
The site and all contents are the property of Elleci di Cattani Linda.
All images, photographs, written or graphic texts and more generally any other intangible asset are protected by international laws and conventions on intellectual property and industrial property.
This means that the Elleci brand, logos, trade names, images, graphics, designs, layouts and product information cannot be copied and used without the written approval of Elleci di Cattani Linda.
However, please note that the website may contain links to other websites outside of the control of the Seller.
The Seller cannot be held responsible for the content or privacy policies of such third party websites.
